Terms of Service

1. Who we are
StormDial Arborist is a product of Aether ("Aether", "we", "us", "our"). These Terms of Service ("Terms") apply to your use of stormdialarborist.com (the "Site") and to any demonstration, consultation or information we provide through it. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. The Site is information, not a contract
The Site describes StormDial Arborist, its features, pricing and territory protection. Nothing on the Site is an offer that creates a binding agreement. A subscription only begins when you sign a StormDial Arborist Agreement with Aether (the "Agreement") and pay any amounts due under it. If anything on the Site conflicts with your signed Agreement, the Agreement controls.
3. Pricing
Prices shown on the Site are in US dollars and exclude taxes. Current pricing is:
- StormDial Arborist Platform: $497 per month plus a $499 one-time setup fee.
- Aether Managed Advertising (optional): $1,500 per month.
- Aether CRM (optional): $149 per month plus a $499 one-time setup fee.
Advertising spend is paid by you directly to Google, Meta or other ad platforms. Aether does not mark up your ad spend. SMS, email, AI and other metered usage may be billed separately. We may change prices on the Site at any time. Price changes for existing subscribers are handled under the Agreement.
4. Exclusive territory
Territory protection means Aether will not provide StormDial Arborist to another competing arborist inside your protected territory while your subscription is active and you comply with the Agreement. It does not stop other businesses from advertising in your area. Territory boundaries are confirmed with you in writing before we accept payment. Territory availability shown on the Site, including on the territory map, is indicative only and is not a reservation. A territory is only protected once your Agreement is signed and payment is received.
5. Booking a demo
When you book a demo, you agree to give accurate information about yourself and your business. We may contact you by phone, email or text message about your demo and about StormDial Arborist. You can opt out of text messages at any time by replying STOP, and out of emails by using the unsubscribe link or emailing us. Booking a demo does not commit you to buy anything.
6. No guarantee of results
StormDial Arborist uses weather data and automation to help you manage your advertising. Weather forecasts can be wrong, and advertising results depend on many factors outside our control, including ad platform policies, competition, budgets and your own operations. Any examples, figures or dashboards shown on the Site are illustrations, not promises of leads, revenue or results.
7. Third-party platforms
StormDial Arborist works with third-party platforms such as Google Ads, Meta, Google Calendar and CRM software. Your use of those platforms is governed by their own terms. We are not responsible for their availability, policies, decisions or charges, including ad disapprovals or account restrictions.
8. Acceptable use
You agree not to misuse the Site. This includes trying to access it without permission, interfering with its operation, providing false or misleading information, or using it for any unlawful purpose.
9. Intellectual property
The Site and its content, including the StormDial and Aether names, logos, text, graphics and software, belong to Aether or its licensors. You may view the Site for your own business evaluation. You may not copy, modify or distribute its content without our written permission.
10. Disclaimers
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, Aether will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to $100. Liability under a signed Agreement is governed by that Agreement.
12. Governing law
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Douglas County, Nebraska.
13. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Site after that means you accept the updated Terms.
